In a move reminiscent of his father’s martial law era, President Ferdinand Marcos Jr. has mandated the integration of the “Bagong Pilipinas” hymn and pledge into weekly flag ceremonies at all government offices and educational institutions nationwide.

The directive, outlined in Memorandum Circular No. 52 signed by Executive Secretary Lucas Bersamin on June 4, aims to “further instill the principles of the Bagong Pilipinas brand of governance and leadership among Filipinos.”

What is ‘Bagong Pilipinas’?

Launched in July 2023, “Bagong Pilipinas” represents the Marcos administration’s governance slogan and leadership brand. It envisions an “all-inclusive plan towards deep and fundamental social and economic transformation in all sectors of society and government.” 

The campaign is “characterized by a principled, accountable and dependable government, reinforced by unified institutions of society.”

The name and concept bear a striking resemblance to “Bagong Lipunan” (New Society), the vision and propaganda of Marcos’ father, the late dictator Ferdinand Marcos Sr., who ruled the Philippines under martial law for over a decade.

During that dark period, Marcos Sr. promised to create a new society free from poverty, hunger, corruption and violence.

Disseminating the Hymn and Pledge

Under the new directive, the heads of all national government agencies, including government-owned and controlled corporations (GOCCs) and state universities and colleges (SUCs), must ensure that the Bagong Pilipinas hymn and pledge are “properly disseminated within their respective institutions and offices.”

The Presidential Communications Office (PCO) has also been tasked to “implement effective measures to communicate and disseminate the Bagong Pilipinas Hymn and Pledge to all government offices and the public.”

Reactions and Criticism

The move has drawn sharp criticism from some lawmakers and activists who see it as an attempt to whitewash the Marcos family’s controversial history and revise the martial law narrative.

House Deputy Minority Leader and ACT Teachers Party-list Rep. France Castro called the directive “reminiscent of the martial law period’s Bagong Lipunan propaganda” and questioned if Marcos is “again imitating his dictator father and bringing back martial rule.

“It would be best for Pres. Marcos Jr. to rescind this self-serving and martial law remnant of a memorandum circular. It is yet another way to deodorize the Marcos name brand and revise history,” Castro said. ” We should just stick with the Lupang Hinirang and Panatang Makabayan.”

The lawmaker warned that the order could be “an attempt to indoctrinate government personnel and the youth with the Marcos administration’s self-styled Bagong Pilipinas branding.” 

Instead of such “gimmicks”, Castro urged the administration to focus on addressing pressing issues like low wages, high prices of goods, unemployment, and lack of quality jobs.

Integrating into Flag Ceremonies

The Bagong Pilipinas hymn and pledge are set to become a regular fixture in the weekly flag raising and lowering ceremonies mandated under Republic Act No. 8491 or the “Flag and Heraldic Code of the Philippines”.

The law requires all government offices, including local government units (LGUs), to conduct flag ceremonies every Monday morning and Friday afternoon.

While the directive applies to all national government agencies and educational institutions, LGUs are only “encouraged” to follow suit in integrating the Bagong Pilipinas hymn and pledge into their flag ceremonies. It remains to be seen how many will adopt the practice.

Section 18 of Republic Act (RA) No. 8491 or the “Flag and Heraldic Code of the Philippines” directs all government offices, including local government units (LGUs), to conduct a flag-raising ceremony every Monday morning and flag-lowering ceremony every Friday afternoon.

Conclusion

The Marcos administration’s move to integrate the Bagong Pilipinas hymn and pledge into government flag ceremonies has sparked both support and opposition.

Bamban Mayor Alice Guo Under Scrutiny for Alleged Ties to Illegal POGOs

Alice Leal Guo, the 37-year-old mayor of Bamban, Tarlac, has come under intense scrutiny in recent months over her alleged ties to illegal Philippine offshore gaming operators (POGOs) in her municipality.

Alice Guo, who made history in 2022 as the first female mayor of Bamban, is now the subject of a Senate investigation and faces potential tax evasion charges from the Bureau of Internal Revenue (BIR).

Senate Probe Raises Questions About Guo’s Background

During a Senate hearing on May 7, 2024 presided over by Senator Risa Hontiveros, Guo struggled to recall basic details about her life and background.

The mayor, who Hontiveros says “came out of nowhere” to win the 2022 election, could not remember the house where she was born, explain why her birth was registered 17 years late, or name the homeschool program she claims to have attended through high school.

Guo’s murky background has led Hontiveros and other senators to question whether she may be a Chinese “asset” planted to infiltrate Philippine politics. Key facts that have emerged about Guo include:

  • She was born on July 12, 1986 but her birth was not registered until she was 17 years old
  • She grew up on a farm raising hogs with her adoptive Filipino father, but the identity of her mother is unknown
  • Guo has no school records and did not attend college
  • She first registered to vote in 2018 at age 31 or 32
  • Guo won the 2022 mayoral election as an independent, defeating her closest rival by just 468 votes
  • Her declared campaign spending in 2022 was only 1,024 pesos below the legal limit, which election experts say is unrealistic

Links to Raided POGO Hubs

Much of the suspicion around Mayor Guo stems from her alleged involvement with two illegal POGOs, Hongsheng Gaming Technology and Zun Yuan Technology, that operated out of a compound she previously co-owned called Baofu.

Hongsheng was first raided in February 2023, and Zun Yuan took its place in the same compound three months later before also being raided in March 2024. The POGOs are suspected of involvement in scams, human trafficking, and cyberattacks on government websites.

Guo admitted during the Senate hearing that she helped Hongsheng get municipal approval to operate in Bamban when she was still a private citizen and owned 50% of the Baofu compound. She claims to have sold her stake before running for mayor.

However, Senator Sherwin Gatchalian noted that Guo’s former business partner in Baofu was a fugitive who escaped the compound during the raids via a network of underground tunnels. As the land owner, Gatchalian suggested Guo must have known about the tunnels, raising further questions.

Lavish Lifestyle Raises Red Flags

Guo’s extravagant lifestyle and assets have also drawn scrutiny, as they appear disproportionate to her declared income and business interests. Some of the red flags include:

  • Guo owns a limited edition McLaren 620R luxury sports car worth around 16.7 million pesos. Only 225 of the vehicles were made before McLaren stopped production in 2021.
  • She admitted during the Senate hearing to previously owning a private helicopter as well.
  • Guo declared a net worth of 429 million pesos in her initial June 2022 SALN, which she then amended down to 286 million, before revising it back up to include more properties and assets.
  • Her business interests include at least 11 companies incorporated since 2010, her first one when she was 24 years old. But their earnings do not seem to justify her immense wealth.

BIR Launches Tax Evasion Probe

Prompted by the revelations from the Senate investigation, the Bureau of Internal Revenue has launched its own probe into Guo’s finances to determine if criminal tax evasion charges are warranted.

BIR Commissioner Romeo Lumagui Jr. said the agency will fully cooperate with the Senate’s efforts and conduct a parallel investigation into Guo and various companies linked to her. If her declared income does not match the value of properties and assets acquired in the same period, Lumagui said tax evasion cases will be filed against Guo and any conspirators.

Senator Hontiveros said she would not be surprised to see Guo charged, noting that “nearly all of the documents under her name are questionable,” from her late-registered birth certificate to her fluctuating SALN. Hontiveros advised the mayor to “come clean” and “tell the truth before it’s too late.”

Suspension and Disqualification Possible

In addition to the BIR investigation, Guo is also facing administrative sanctions over her alleged POGO links. The Office of the Ombudsman has already ordered Guo to be suspended for up to 6 months in connection with graft charges filed by the Department of the Interior and Local Government (DILG).

The DILG accused Guo of allowing the illegal POGOs to operate in Bamban. While Guo has appealed the suspension order, calling the charges baseless, she could face further penalties.

Comelec Chairman George Garcia noted that while the poll body accepts certificates of candidacy in good faith, Guo could still be held liable for perjury if her declarations are proven false. He said any citizen can file a quo warranto petition in court to challenge Guo’s citizenship and eligibility to serve as mayor.

Senators Renew Call for POGO Ban

The revelations about Guo’s case have reinvigorated calls from senators and other officials to completely ban POGOs in the Philippines. While the offshore gaming industry generates significant revenue, it has been plagued by crime, corruption and social ills.

Finance Secretary Benjamin Diokno said the government is carefully studying the proposed POGO ban, but is also consulting with PAGCOR on the potential economic impact. Diokno noted that many businesses labeled as POGOs are really fronts for other illegal activities.

Senators Hontiveros and Gatchalian have commended the BIR’s swift action on Guo’s case, saying her companies’ finances don’t add up. Hontiveros said her Senate committee is ready to share its evidence with the BIR to assist the tax evasion probe.

The Future for Guo Remains Uncertain

As the investigations into her background and alleged POGO ties move forward, Alice Guo’s political future remains very much in doubt. If the charges against her are substantiated, she could face years in prison and be permanently barred from public office.

The case has already sparked a broader discussion about the need for tighter scrutiny of candidates’ backgrounds and more safeguards against foreign meddling in Philippine politics. Some have even called for a review of the country’s liberal policy on granting citizenship, especially to those with suspicious wealth.

For Mayor Guo, who rose from obscurity to become the unlikely chief executive of Bamban, the walls appear to be closing in fast. While she maintains her innocence, the questions about her identity, background and business dealings are only mounting.

As Senator Hontiveros put it, the truth about Alice Guo needs to come out, as a matter of national security. For now, the beleaguered mayor’s best hope may be to heed the senator’s advice – come clean before it’s too late.

Philippine Offshore Gaming Operators, or POGOs, are online gambling companies based in the Philippines that offer services to customers outside the country.

These entities are licensed and regulated by the Philippine Amusement and Gaming Corporation (PAGCOR) to operate legally.

POGOs fall under three main categories:

  1. E-casinos – Online casinos that operate in real-time, usually offering a variety of games
  2. Sports betting – Gambling that involves predicting results and placing bets on sporting events
  3. Sportsbetting on Regulated Wagering Events (SBRWE) – Regulated by other jurisdictions and provides live audio/visual feeds of events to consumers

Under Philippine law, only foreigners based outside the country and over 21 years old can participate in POGO gambling. 

Filipinos residing abroad and foreign nationals in the Philippines are prohibited from playing. The majority of POGO customers are Chinese, as gambling is illegal in China.

The Rise of the POGO Industry in the Philippines

POGOs began operating in the Philippines in the early 2000s, but it was only in 2016, under the Duterte administration, that the government started officially regulating the industry through PAGCOR.

The number of POGOs rapidly expanded after 2016, especially in Metro Manila. By 2019, there were nearly 300 POGO licensees, employing over 100,000 Chinese workers. 

This sudden growth was attributed to rising Chinese influence under Duterte.

POGOs became a ubiquitous part of daily life, with many Chinese-run establishments sprouting up.

The industry generated significant revenues for PAGCOR, increasing by 497% from ₱657 million in 2016 to ₱7.365 billion in 2018. In 2019, POGO contributions peaked at an estimated ₱104.5 billion or 0.67% of GDP.

Economic Benefits and Costs of POGOs

The POGO industry provides several economic benefits to the Philippines:

  • Tax revenues – POGOs pay 5% tax on gross gaming revenues and 25% income tax on non-gaming revenues. From January-August 2022, the BIR collected ₱4.4 billion in taxes from POGOs.
  • Employment – As of June 2022, POGOs directly employed 16,700 Filipinos and indirectly supported 20,000 more jobs in related industries. During the 2019 peak, direct and indirect employment reached 46,000.
  • Real estate demand – POGOs occupy around 1 million sqm of office space and 2.4 million sqm of residential space, mostly in Metro Manila. Annual office and housing rents amount to ₱18.9 billion and ₱28.6 billion respectively.
  • Ripple effects on other sectors – POGOs drive demand in the retail, food service, transportation and utilities industries. Their total economic contribution in 2019 was estimated at ₱104.5 billion or 0.67% of GDP.

However, there are also economic costs and risks associated with POGOs:

  • Potential real estate crash – A complete POGO exit would result in large amounts of vacated office and residential space, and ₱18.9 billion in lost annual office rents alone. This could negatively impact the property sector.
  • Crowding out other industries – The rise of POGOs may come at the expense of attracting investments in other job-generating sectors. Chinese-dominated POGOs are seen as operating through government favor.
  • Money laundering risks – Around 26% of the ₱54 billion in POGO transactions from 2017-2019 were flagged as suspicious by the Anti-Money Laundering Council. Illicit financial flows could undermine the business environment.
  • Foregone Chinese tourism – China’s crackdown on cross-border gambling puts at risk Chinese tourist arrivals, which hit 1.74 million in 2019, the 2nd largest market. Beijing may impose a travel ban to pressure the Philippines to stop POGOs.

Social Costs and Illegal Activities Linked to POGOs

Apart from economic considerations, POGOs are also associated with various social ills and criminal activities:

  • Prostitution and human trafficking – The influx of Chinese POGO workers drove up cases of prostitution and trafficking, with women recruited or forced into sex work.
  • Kidnapping and violent crime – Police data links rising incidents of kidnapping, illegal detention, and homicide to POGO-related disputes, often victimizing Chinese nationals.
  • Tax evasion and illegal labor practices – Many POGOs fail to properly pay taxes and social security contributions for workers. Some employ Chinese without valid permits or in poor working conditions.
  • Corruption – The rapid growth of POGOs allegedly involves corruption in the processing of permits and shielding of illegal operators.
  • Threat to national security – Legislators warn that the proliferation of Chinese-run POGOs, their physical proximity to military camps, and lax immigration controls pose security risks.

These social costs have prompted calls from lawmakers, government agencies, and the Chinese embassy to ban POGOs as the harms outweigh economic gains. 

China brands POGOs as the “most dangerous tumor in modern society” that undermine China-Philippines relations.

Stricter Regulation and Uncertain Future of POGOs

Facing pressure to address POGO-related issues, PAGCOR and other government bodies are moving to impose stricter regulations on the industry. Some key measures include:

  • Crackdown on illegal POGOs – PAGCOR has stepped up closure of unlicensed operators. In 2019, nearly 200 illegal POGOs were shut down. Authorities have also deported thousands of errant Chinese workers.
  • Improved tax collection – The BIR has begun more stringent collection of withholding taxes and VAT from POGOs and service providers. From late 2021 to early 2022, it garnered ₱709 million in POGO taxes.
  • Re-evaluation of all licensees – PAGCOR is requiring all existing POGOs and service providers to reapply under a new regulatory framework with stricter standards for beneficial ownership and accountability.
  • Harsher penalties for violations – POGOs found to be exceeding their license terms face endorsement for cancellation. Those failing to reapply properly may lose their authorization to operate.
  • Interagency coordination – PAGCOR is boosting cooperation with tax, immigration and law enforcement bodies for better monitoring and investigation of POGO hubs and employees.

Despite efforts to clean up the industry, the future of POGOs remains uncertain.

Continued crime incidents and social backlash, China’s strong opposition, and global economic headwinds exacerbated by the pandemic have led to a decline in POGO numbers and revenues.

As of May 2022, only 34 POGO licenses remain active, down from a 2019 peak of around 300. Revenues plunged to just ₱1.67 billion in 2022 from over ₱7 billion pre-pandemic. Office vacancies are rising as POGOs downsize or exit.

Moving forward, the Philippine government must carefully weigh the shrinking economic benefits against the social and reputational costs of the POGO industry.

Stricter and more transparent regulation is crucial to addressing harms and restoring trust. But some observers believe that an outright ban may be inevitable.

As legislators and citizens continue to scrutinize POGOs, the coming months will be critical in determining the long-term viability and impact of online gambling in the Philippines.

Only time will tell if this experiment in offshore gaming will be deemed a success or failure in the nation’s development.
